Draft of the CDCR Form 1707, Request for Victim Services. Due to Senate Bill
852 (Electronic Notification) which is being signed into law and having an urgency
clause, OVSRS is making changes to this form. As indicated this morning, OVSRS
has added language about Postrelease Community Supervision/Probation. Also
a redacted copy of a Demand for Payment letter. After release from an institution,
if there is an outstanding balance of court ordered victims restitution, the
offender will receive this letter.

Realignment

On April 4, 2011, Governor Brown signed Assembly Bill 109, the Public Safety
Realignment Act. This Act becomes effective October 1, 2011, and makes significant
changes to felony sentencing laws, and assigns courts a new and significant
role in the revocation process for offenders who violate their terms or conditions
of post-release supervision.
This Act will also have
a significant impact on California Probation Departments and how they do business.
And, while California Probation prepares for this Realignment, I wish to provide
information on the effects this Act will have on the Interstate Compact process
insofar as Probation is concerned.
Per this Act, under PC 3450, Offenders released from custody are termed Post-Release
Community Supervision (PRCS) offenders. As such, they areunder the supervision
of local probation Departments and no longer under the jurisdiction of Parole.
However, for purposes of the Interstate Compact---when the PO submits the Transfer
Packet for a PRCS case, the PO shall select “Parole” when determining
the “Type of Supervision” on the Transfer Request form. Additionally,
PRCS cases are not subject to restitution issues as initially thought under
PC 11177.2 (a). Therefore, outstanding restitution issues should not be used
as a legal criteria for preventing a PRCS case from transferring his supervision
case out of California. Note:
Prison Staff do not have access to ICOTS and cannot input anything into the
ICOTS database.

Mental Health contacts (and their backups for each institution) that was provided to us by CDCR. County Mental Health can contact these individuals about specific inmates being released on PRCS.

State Parole Department
regarding Tuberculosis codes advised that they are not always screened upon
exit so the slips in our packets/files may be out dated as far back as entry
into prison. It is probably a good idea to have all parolees sent to Public
Health for screening. The codes for TB mean the
following
Anything ending in 1= person has active TB
Anything ending in 2- Person is clear
Anything ending in 3= person has had positive test or exposure, treat with caution
(mask).
The parole department is not always advised of HIV or AIDS status nor are they
advised of Hepatitis status.

INS, Parolees in State Hospitals, M/NRP, etc; also NOTE that this data is based
upon CalParole that does not include historical data - if a parolee was released
multiple times during the 6 month time period that information is not included,
only the final release is reflected in this data): Total Releases: 39,770.
Total Parolees with a Violation within 30 days of Release: 3,787 (9.5%) Total
Parolees with a Violation within 30 days of Release Resulting in a Referral
to the BPH: 637 (1.6%) Total Parolees with a Violation within 30 days of Release
Resulting in a Referral to the BPH: 3,150 (7.9%)
